ToggleReceiving a court summons or warrant at your residential address can be extremely stressful, particularly when you are living in another city or state and the document has been issued by a court in Ahmedabad or Gandhinagar.
Many people immediately start searching online:
“I received a court summons at home, what should I do?”
“Summons received from Ahmedabad Court – what is the next step?”
“Court case in Ahmedabad but I live in another city – do I have to appear personally?”
“How to cancel a warrant issued by Ahmedabad Court?”
“Can a lawyer appear on my behalf in Ahmedabad Court?”
The answer depends upon the nature of the case, the stage of proceedings and the exact process issued by the Court.
A person should therefore not ignore the document or assume that travelling immediately to Ahmedabad or Gandhinagar is the only option.
What Does It Mean If You Receive a Court Summons?
A court summons is a formal direction requiring a person to appear before the concerned court in connection with a proceeding.
In a criminal case, a summons may be issued to an accused after the court takes cognizance and finds sufficient grounds to proceed.
Under Section 227 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), where a Magistrate takes cognizance and finds sufficient grounds to proceed, a summons may be issued in a summons-case. In a warrant-case, the Magistrate may issue a warrant or, if appropriate, a summons requiring the accused to appear before the court.
Therefore, receiving a summons does not by itself mean that the accused has been found guilty.
It is an important procedural stage at which the accused should obtain legal advice and understand the case before taking the next step.
What If You Live Outside Ahmedabad or Gandhinagar?
This is one of the most common situations.
For example:
- You live in Surat, but receive a summons from an Ahmedabad Court.
- You live in Rajkot, but a criminal complaint is pending in Ahmedabad.
- You live in Vadodara, but receive a summons from Gandhinagar Court.
- You live in Mumbai, Delhi, Rajasthan or another State, but a case has been filed against you in Ahmedabad.
- You have shifted to another city after a transaction or business dispute in Ahmedabad.
In such circumstances, do not simply ignore the summons because you are living outside the jurisdiction of the Court.
The first step should be to obtain and examine the complete case details.
Step 1: Verify the Court Summons
Before taking any action, verify:
- Name of the Court
- Case number
- CNR number, if available
- Name of the complainant
- Name of the accused
- Sections/offences mentioned
- Date fixed for appearance
- Whether it is a summons, warrant or another process
- Whether a copy of the complaint/FIR/chargesheet is attached
This is important because the legal remedy depends upon the exact nature of the proceeding.
Step 2: Find Out Why the Case Has Been Filed
A person may receive a summons because of several types of proceedings, including:
- Private criminal complaint
- Cheque bounce case under Section 138 of the Negotiable Instruments Act
- Criminal case arising from an FIR
- Business or commercial dispute involving criminal allegations
- Matrimonial dispute
- Complaint alleging cheating or breach of trust
- Other offences under the Bharatiya Nyaya Sanhita or special statutes
The accused should obtain the relevant pleadings and court records before deciding how to respond.
Step 3: Do Not Ignore the Date Mentioned in the Summons
One of the biggest mistakes is simply ignoring a summons because the accused lives in another city.
Failure to appear may result in the Court taking further steps depending upon the circumstances.
If personal attendance is genuinely difficult, the appropriate application may be considered before the concerned Court.
The exact remedy depends upon the stage of the proceedings and the nature of the process already issued.
Can an Accused Appear Through a Lawyer Instead of Personally?
In appropriate cases, yes.
Section 228 of the BNSS specifically provides that when a Magistrate issues a summons, the Magistrate may, where there is reason to do so, dispense with the personal attendance of the accused and permit appearance through an advocate. The Magistrate can subsequently direct personal attendance if considered necessary.
Therefore, a person living outside Ahmedabad should not automatically assume that he or she must personally travel to Ahmedabad on every date.
The possibility of exemption from personal appearance must be examined based on:
- Nature of offence
- Stage of proceedings
- Previous conduct
- Distance from the Court
- Whether personal presence is required
- Whether the accused is represented by counsel
- Any previous orders passed by the Court
What If It Is a Warrant Instead of a Summons?
A warrant is more serious than a simple summons, and the exact nature of the warrant is extremely important.
The BNSS contains separate provisions concerning warrants, including provisions regarding their form, execution and execution outside the jurisdiction of the issuing Court.
Therefore, if the document says:
“Bailable Warrant”
or
“Non-Bailable Warrant (NBW)”
you should immediately consult a criminal lawyer and have the court record examined.
Do not assume that a warrant can simply be ignored because you are residing outside Ahmedabad or Gujarat.
What If a Non-Bailable Warrant Has Been Issued by Ahmedabad Court?
This is a particularly urgent situation.
If a Non-Bailable Warrant (NBW) has been issued, the accused should obtain the order by which the warrant was issued and understand the reason behind it.
Depending upon the facts, an advocate may consider appropriate proceedings such as:
- Application for recall/cancellation of the warrant before the concerned Court
- Application for bail
- Appropriate application for exemption from personal appearance
- Revision or other appropriate proceedings where legally maintainable
- Appropriate proceedings before the High Court in suitable cases
The correct remedy depends on the case history.
Do not wait until the police attempt to execute the warrant before seeking legal advice.
Can You Hire an Ahmedabad Lawyer Even If You Live in Another City?
Yes.
If the case is pending before a Court in Ahmedabad or Gandhinagar, you can engage an advocate practicing before the concerned Court.
This can be particularly useful if you live in:
Surat | Vadodara | Rajkot | Bhavnagar | Jamnagar | Mehsana | Anand | Bharuch | Vapi | Mumbai | Delhi | Rajasthan | Maharashtra | or another State.
Your advocate can examine the case papers, identify the stage of proceedings and advise you whether your personal appearance is required or whether an appropriate application can be made seeking exemption.
What Documents Should You Send to Your Lawyer?
If you are living outside Ahmedabad and have received a summons or warrant, initially send your lawyer clear copies of:
- Court summons/warrant
- FIR, if applicable
- Complaint
- Chargesheet, if applicable
- Previous court orders
- Bail order, if any
- Case number/CNR number
- Any notice received earlier
- Relevant transaction documents
- Your identification and current address details
The lawyer can then verify the case status and determine the appropriate course of action.
What If You Never Received Any Previous Notice?
This is also important.
Sometimes an accused may receive a summons or warrant without being aware that proceedings have already been initiated.
In such a situation, the advocate should examine the service reports and previous orders of the Court.
If a warrant was issued after alleged non-appearance, it may be important to determine:
- Whether summons was properly served
- Whether the accused had knowledge of the proceedings
- Whether the address was correct
- Whether there was any genuine reason for non-appearance
- Why the Court proceeded to issue the warrant
The answer may materially affect the appropriate legal strategy.
Can the Gujarat High Court Be Approached?
In appropriate cases, proceedings before a subordinate criminal court may be challenged or appropriate relief may be sought before the Gujarat High Court at Ahmedabad.
However, approaching the High Court is not automatically the first remedy for every summons or warrant.
The appropriate forum depends upon:
- Nature of the criminal case
- Stage of proceedings
- Order challenged
- Availability of an alternative remedy
- Jurisdictional issues
- Legal grounds available
A lawyer should examine the complete record before advising whether a High Court petition is appropriate.
What Should You Do If You Receive an Ahmedabad Court Summons While Living in Another State?
A practical approach is:
1. Do not panic.
Receiving a summons does not mean that you have already been convicted.
2. Do not ignore it.
The Court’s process should be taken seriously.
3. Obtain the complete case details.
Find the case number, court, sections and next date.
4. Consult a lawyer practising in Ahmedabad.
A local advocate can inspect the proceedings and determine the current stage.
5. Check whether personal appearance is actually necessary.
Depending upon the case, an application for exemption from personal appearance may be considered.
6. If a warrant has been issued, act immediately.
The strategy for a warrant is different from the strategy for an ordinary summons.
7. Preserve all documents.
Do not discard the summons, envelope, postal record or other documents received from the Court.
